Costs of Bargaining

Breyer refers to the "costs of bargaining," but what ARE they?

  1. Some of the main costs would be time and information. Think about what you'd need to know before engaging in a bargain with a polluting entity regarding how much you'll accept (or be willing to pay if the polluter has the right to pollute) to allow the pollution on you/your property to occur. You'd have to know the levels of pollution, the kinds of harm that pollution does at different levels of exposure and how much it is worth to you not to experience those effects. So, how much is it worth to you not to be exposed to a pollutant that creates a cancer risk of 1 in 25,000 people exposed at your level over a lifetime?
